Woman sues after mother allegedly dies after fall sustained during dialysis treatment

NEW ORLEANS – The daughter of a patient who allegedly received fatal injuries after a technician failed to assist her to the restroom during a dialysis session is suing.

Michelle Richards filed suit against LaDonna Doe, DaVita Healthcare Partners Inc. and DaVita Dialysis in the Orleans Parish Civil District Court on July 29.

Richards claims that on Oct. 21, 2013, Barbara Richards, mother of Michelle Richards, underwent dialysis treatment at DaVita Dialysis located at 2620 Jena St. in New Orleans. While undergoing treatment, Barbara Richards advised DaVita technician Doe that she had to use the restroom. LaDonna agreed, the suit says, allowing Richards to access the facilities without an aid or escort resulting in Richards falling on her way to the restroom and sustaining severe spinal injuries that allegedly led to her death on Oct. 22, 2013.

Doe is accused of failing to escort Barbara Richards to the bathroom, monitor Richards’ blood pressure when disconnecting her from dialysis and not instituting fall or near fall protocol.

DaVita Dialysis is accused of failing to properly train technicians in the procedure of disconnecting patients from dialysis, properly supervise its technicians, and failing to properly train technicians in fall or near fall protocol.

The plaintiff is seeking an unspecified amount in damages for pain and suffering, medical and funeral expenses, loss of love and affection, loss of society and companionship, loss of performance and material services and loss of support.

The plaintiff is represented by attorney Patrick G. Kehoe Jr.

The case has been assigned to Div. H Pro Tempore Judge Lynn Luker.
