Borrowed equipment leads to $34K lawsuit

NEW ORLEANS – An equipment rental company is suing a construction company for allegedly failing to pay back several thousand of dollars worth of rented equipment.

NES Equipment Services Corporation and NES Rentals filed suit against Covasa Construction LLC and Valerion Ioan Covasa in the Orleans Parish Civil District Court on Aug. 14.

NES claims the company entered in to an agreement with Covasa on Sept. 21, 2009. Valerion Ioan Covasa, in association with Covasa Construction LLC, also allegedly signed on to the agreement.

The contract promised the delivery of rented equipment to 5300 Barkley Drive, Algiers. Covasa used an open account to obtain the rented equipment between Feb. 19 and April 30. On June 26, NES sent a request demanding the amount owed from the equipment, approximately $34,408.35, plus contractual and judicial interest. Covasa has allegedly failed to respond to the written demand within the appropriate deadline of 30 days.

NES Equipment Services Corporation is represented by Jonathan M. Walsh of Deutsch, Kerrigan & Stiles LLP.

The case has been assigned to Div. D Judge Lloyd J. Medley.
