Magnolia Discount gas station sued by customer who alleges injury in fall near gas pumps

GRETNA – A gas station customer claims she was severely injured in a slip and fall on a slippery substance near the gas pumps.

Cheryl Bartlett filed suit against LKM Convenience LLC, Magnolia Discount and Mesa Underwriter’s Specialty Insurance Company in the 24th Judicial District Court on Aug. 12.

Bartlett asserts that on Aug. 22, 2013 she was a customer at the Magnolia Discount gas station located on Saint Claude Avenue in New Orleans when she stepped in a clear and extremely slippery substance and fell to the pavement near a gas pump. The plaintiff claims she suffered severe mental and physical injuries in the incident.

The defendant is accused of failing to adequately inspect the premises, failing to place warning signs around the hazard and failing to corrective measures.

An unspecified amount in damages is sought for pain and suffering, mental pain and anguish and medical expenses.

Bartlett is represented by Michael H. Hesni of the Gretna-based Law Office of Michelle H. Hesni PLC.

The case has been assigned to Division G Judge Robert A. Pitre Jr.

Case no. 741-179.
