NEW ORLEANS – A teacher's assistant is suing after she was allegedly injured when a stack full of chairs fell on her when she was accessing cabinets in her classroom’s kitchen.
Emma Warren filed suit against Ace Property and Casualty Insurance Company, GCA Services Group Inc., GCA Education Services Inc., ESIS Inc. and an unknown employee in the Orleans Parish Civil District Court on Aug. 15.
Warren states that on Aug. 19, 2013, she was employed as a teacher’s assistant at Lake Area New Tech Early College High School in New Orleans. On this date, petitioner Emma Warren proceeded to enter the kitchen attached to her classroom to access a cabinet above her, failing to notice numerous metal chairs placed on top of the cabinets by an unknown employee prior to the start of the school year on Aug. 5, 2013. While accessing one of the cabinets, a chair, without warning, allegedly fell on top of Warren causing her severe injuries.
The plaintiff contends she suffered debilitating spine and shoulder injuries as a result of the incident.
The defendants are accused of carelessly placing metal chairs on top of kitchen cabinets, failing to remove the heavy metal chairs prior to the 2013 school year, to act in a responsible manner when dealing with furniture, hiring an inattentive employee, failing to train or supervise this employee and failing to establish appropriate protocol for its janitorial staff.
The plaintiff is seeking an unspecified amount in damages for pain and suffering, disabilities, mental agony, loss of enjoyment, medical expenses and decline in future income.
