Man sues Harrah’s Casino for allegedly being stuck in an elevator for an hour

NEW ORLEANS – A man who was stuck in an elevator for an hour after he  panicked when it fell 12 inches is suing a casino where the incident allegedly occurred.

Marlon Pierre, Sr. filed suit against Caesars Entertainment Operating Company Inc., Harrah’s Casino New Orleans, Schindler Elevator Corporation and Zurich American Insurance Company in the Orleans Parish Civil District Court on Aug. 22.

Pierre, Sr. states that on Aug. 31, 2013, he was a patron at Harrah’s New Orleans Casino when he allegedly became trapped in an elevator for approximately one hour. The elevator then proceeded to fall precisely 12 inches, resulting in the plaintiff saying he experienced extreme claustrophobia, dehydration, panic and severe injuries.

The plaintiff contends he suffered brutal shock to his nervous system and psyche as well as acute injuries to his body.

The defendants are accused of negligent training of employees, hiding preexisting knowledge of the defective elevator, failing to repair said elevator, failing to block off the hazardous elevator, failing to address the situation in a timely manner, failing to establish elevator protocol and regulations and failing to place warning signs in or around the defective elevator.

The plaintiff is seeking an unspecified amount in damages for medical expenses, emotional turmoil, pain and suffering and mental agony.

Attorney Barry J. Landry represents the plaintiff.

The case has been assigned to Div. H Pro Tempore Judge Lynn Luker.
