NEW ORLEANS – A man driving a 2010 John Deere mower is suing after allegedly being injured when he was thrown out of the rear glass window of his vehicle as a result of a severe collision with a large truck.
Gregory Raymond filed suit against E&W Postal Services Inc., Progressive Specialty Insurance Agency Inc. and Ronald Robertson in the Orleans Parish Civil District Court on Sept. 12.
Raymond claims that on Sept. 16, 2013, he was driving his 2010 John Deere mower down the Southbound lane of LA Highway 3219, when he was allegedly struck on his left side by a box truck owned by the aforementioned defendants. As a result of the collision, the petitioner’s mower spun counter clockwise causing it to roll over. The sheer force of the impact allegedly led to the ejection of the plaintiff through the mower’s rear glass window.
The plaintiff contends he suffered injuries to his arm, left flank and elbow as well as road rash as a result of the incident. Raymond was also immediately rushed via ambulance to St. Elizabeth Hospital in Gonzalez following the collision.
The defendants are accused of failing to yield, exercise caution, observe with diligence and of driving recklessly.
The plaintiff is seeking an unspecified amount in damages for pain and suffering, mental anguish, disabilities and medical expenses.
