GRETNA – A grocery store is being sued by a grandfather who claims he was injured after overturning a cart on top of himself after slipping and falling in a puddle of water.
Elias Ned, and wife Betty, filed suit against Winn Dixie Louisiana Inc. and their insurer in the 24th Judicial District Court on Sept. 30.
Ned claims that he was shopping at the Winn Dixie grocery store located at 3623 Jefferson Highway in Jefferson when his path was blocked by display cases forcing him to go around them and step right into a puddle of water that caused him to slip and fall and overturn his shopping cart on top of him. The plaintiff alleges that his grandson went to tell store personnel about the incident, but when the manager arrived on the scene five or six minutes later and simply told him to go to the doctor. Ned contends that he was severely injured in the incident.
The defendant is accused of failing to safely operate the store, presenting a hazard to guests, failing to exercise reasonable and diligent supervision, disregarding the safety of others, disregarding obvious dangers, failing to exercise diligence in supervision and failing to ensure the plaintiff received proper medical attention.
An unspecified amount in damages is sought for physical pain and suffering, physical disability, loss of the ability to enjoy life and pursue happiness, emotional distress, medical expenses and loss of consortium.
