GRETNA – A contractor is alleging in a lawsuit that the manufacturer of windows it installed in a house is liable for water that leaked into and damaged the residence.
Tag Homes Inc. filed suit against Enlight Industries LLC and Showcase Custom Vinyl Windows and Doors in the 24th Judicial District Court on Oct. 6.
Tag Homes Inc. alleges that it entered into a contract to construct a home for a property owner at 130 Lamarque Street in Mandeville. The plaintiff contends that as part of the contract they chose windows designed, manufactured and distributed by the defendants to install in the home. Tag Homes Inc. asserts that it installed the windows delivered by the defendants and shortly afterward found that they were leaking and allowing water into the home that caused floors to buckle. The plaintiff contends that after they contacted the manufacturer to tell them of the problems Enlight Industries LLC sent a technician to the home to repair the windows but found they were defective and needed to be replaced. The plaintiff alleges that no further action was taken by the defendants to replace or repair the allegedly defective windows.
The defendant is accused of breach of contract.
An unspecified amount in reasonable damages is sought by the plaintiff.
