GRETNA – An electrical contractor is being sued by a customer for breach of contract for allegedly abandoning a project after receiving 90 percent of the payment, but only completing only 30 percent of the work.
Douglas Brown Jr. filed suit against Spark Electric A/C Heating Gas LLC and Kevin Williams in the 24th Judicial District Court on Oct. 17.
Brown alleges he contracted Spark Electric A/C Heating Gas for the amount of $40,165 to provide work on his building located at 11329 Jefferson Highway in River Ridge. The plaintiff contends that the defendant was to install a pole, wiring and several other electric components. Brown asserts that under the contract it was the responsibility of Spark Electric A/C Heating Gas to apply for and maintain all necessary permits and provide all labor, materials and work required to complete the job.
The plaintiff claims that simultaneous with the first contract he executed a second contract worth $42,222.36 to install air conditioning units and associated electrical components. However, Brown alleges after he had paid a combined $72,193.68 of the amount due under the contracts, Spark Electric A/C Heating Gas discontinued work on the project after having performed only about 30 percent of the contract work.
The defendant is accused of breach of contract.
An unspecified amount in damages is sought for costs the plaintiff has incurred due to work stoppage and delay at the work site.
