GRETNA – One of the beneficiaries of a $1.3. million trust is suing its executor for allegedly mismanaging funds.
Steven Carroll filed suit against Isabel Wingerter, individually and as trustee for the Carroll Trust, in the 24th Judicial District Court on Dec. 15.
Carroll claims that Wingerter prepared the legal standing for the Carroll Trust on Feb. 14, 1999 at the behest of Kenneth E. Carroll in his last will and trust and that her preparation was overseen by notary public Donald Wingerter. The plaintiff alleges that the Carroll Trust was established in October 2008, a year after the death of Kenneth E. Carroll in which Wingerter was named the trustee.
Carroll contends that various family members of Kenneth E. Carroll were to be the trust beneficiaries and that upon his death $1.3 million was deposited into the trust from various sources and that the beneficiaries were to receive a quarter share each of the trust. However, the plaintiff asserts that Wingerter failed to keep appropriate records and wrongfully commingled funds in the trust account, which has resulted in the wrong amount being paid out to its beneficiaries.
The defendant is accused of breach of fiduciary duty, mismanagement, neglect of duty and malpractice.
An unspecified amount in damages is sought for loss of trust funds and loss of inheritance.
Carroll is representing himself pro se in the case.
The case has been assigned to Division O Judge Danyelle M. Taylor.
