Casey Jones Supermarket sued after customer claims head, neck injury from falling boxes

GRETNA – A local grocery store is being sued by a customer who claims she was injured when a stack of boxes fell on her head and neck.

Barbara Thibodaux filed suit against Casey Jones Supermarket and Travelers Property Casualty Company of America in the 24th Judicial District Court on Dec. 23, 2014.

Thibodaux claims that on Dec. 31, 2013 she was a patron at Casey Jones Supermarket located at 21 Westside Shopping Center in Gretna when she was taking an item out of a refrigerated cooler and a stack of flattened boxes fell on her. The plaintiff alleges she received severe injuries to her neck, back and shoulders in the incident.

The defendant is accused of failing to warn patrons of foreseeable hazards, failing to maintain goods in a safe condition, failing to use ordinary care in placement of goods, failing to routinely and carefully inspect goods and failing to take necessary precautions to avoid the accident.

An unspecified amount in damages is sought for mental pain and anguish, physical and and suffering, loss of function, medical expenses and loss of enjoyment of life.

Thibodaux is represented by Nancy S. Silbert of New Orleans-based Wolfe, Begoun & Pick LLC.

The case has been assigned to Division O Judge Danyelle M. Taylor.
