GRETNA – A landlord is suing a horticulture and landscaping business for alleged property damage.
David Cooper filed suit against Landscaping Horticultural Services LLC in the 24th Judicial District Court on Jan. 16.
The plaintiff asserts he leased property located at 562 Iris Ave. in Jefferson to Landscaping Horticultural Services from Oct. 1, 2008 until March 14, 2014. During the time of the lease Cooper claims the defendants agreed to keep the premises in reasonable condition, but after the business moved out it was determined workers had torn down a large fence encompassing the property and failed to replace it. Although the plaintiff alleges he has asked the defendant to replace the the fence, it has failed to do so requiring him to bear the cost to install a new fence rendering him unable to lease the property in the interim.
The defendant is accused of breach of contract and property damage.
An unspecified amount in damages is sought for repair costs, attorney’s fees and legal costs.
Cooper is represented by J. Andrew Murrell of the Baton Rouge-based Andrew Murrell Law Firm.
The case has been assigned to Division D Judge Scott U. Schlegel.
Case no. 745-910.
