GRETNA – A Westwego homeowner is suing a commercial developer who constructed numerous commercial buildings around his home that he claims has resulted in flooding of his property as well as other damage.
Kent D. Trosclair Sr. filed suit against Westbank Investment Group LLC, Hi-Tech Commercial Contractors LLC and LESY LLC in the 24th Judicial District Court on Feb. 3.
Trosclair asserts that he owns a home located at 286½ Louisiana St. in Westwego where Westbank Investment purchased several nearby parcels of land and began to construct commercial developments. The plaintiff claims that a Family Dollar Store was constructed on the lot directly behind his house and a medical clinic was constructed on a nearby lot. Trosclair alleges that as a result of the construction, water drainage in the area has changed and his home has subsequently been flooded on numerous occasions. The plaintiff contends that under Westwego city code the defendant should have built retaining walls to protect his property from such flooding.
Also, Trosclair claims that the loading and unloading of a commercial dumpster located near his garage has resulted in vibrations that have damaged the structures.
The defendant is accused of property damage.
An unspecified amount in damages is sought by the plaintiff.
