GRETNA – A forklift driver and his employer are being sued by a motorist’s insurer who claims her vehicle was struck by the forklift when driving down a public street.
State Farm Mutual Automobile Insurance Company, as partial subrogee of Cheryl Boydell Braunner, filed suit against Lionell M. Pendleton, DMP Building Products Inc., Amazing Windows & Doors and Nautilus Insurance Company in the 24th Judicial District Court on Feb. 12.
The plaintiff asserts that on Dec. 9, 2013 its customer, Braunner, was driving her 2012 Buick Regal on Hessmer Avenue in Metairie and attempted to cross the street in front of her, colliding with her vehicle. State Farm claims Braunner’s vehicle was damaged in the accident for which she had to pay a deductible to have repaired.
State Farm contends that during the course of the accident Pendleton was working in the course and scope of his employment with DMP Building Products Inc. and Amazing Windows & Doors.
The defendant is accused of failing to maintain a proper lookout, failing to see what should have been seen, failing to obey the rules of the road and failing to yield to the right of way.
An unspecified amount in damages is sought for cost of reapers and reimbursement of deductible.
State Farm is represented by attorney James E. Brouillette of Metairie.
The case has been assigned to Division C Judge June Berry Darensburg.
