GRETNA – A property holding company is suing its real estate agent who allegedly provided himself with a heightened commission without disclosing it during the course of the sale of a lot.
GRY Investments LLC filed suit against GBS Properties LLC and Anthony Grosch in the 24th Judicial District Court on Feb. 20.
GRY Investments contends it was the owner of a lot located in the Brooklyn Pastures Subdivision in Gretna that was listed for sale by GBS Properties with Grosch serving as real estate agent. The plaintiff asserts Grosch advised to offer a 12 percent commission rate to bring in a purchaser.
GRY Investments claims that on Sept. 27, 2014 it received an offer on the lot for $675,000, but authorized Grosch to reply with a counteroffer at $700,000 that the purchaser accepted. However, the plaintiff alleges the counteroffer had a handwritten note on it saying that Grosch would receive a 12 percent commission on the sale, which it had never agreed to and was not discovered until after the property sale had been closed. GRY Investments contends had it known of the commission amendment to the sales contract it would not have agreed to it.
The defendant is accused of breach of fiduciary duties.
Damages equal to the excess commission payment are sought by the plaintiff.
