Illinois Central Railroad sued over rail yard injury

A Metairie railroad conductor has sued a railroad company he alleges is responsible for a 2014 injury.

Albert Aucoin filed a lawsuit April 27 in U.S. District Court for the Eastern District of Louisiana, New Orleans Division against Illinois Central Railroad Co., citing negligence.

According to the complaint, on May 1, 2014, Aucoin, a 54-year-old conductor working for the New Orleans Public Belt Railroad Co., was in the defendant's Mays Yard in Louisiana. "While Aucoin and his crew were performing their work on track 10," the lawsuit states, "an Illinois Central Railroad crew was also operating in the yard. This crew carelessly and negligently kicked a cut of cars into track 10, [that] collided violently with the engine on which Aucoin was seated. The force of the collision violently threw him about in his seat. The subsequent slack action threw him to the floor."

The plaintiff cites severe and permanent injuries to his back and neck.

Aucoin seeks in excess of $500,000, plus costs, to cover: past and future lost wages; permanent impairment of earning capacity; past and future pain and anguish; past and future medical expenses; and his inability to live his life normally.

He is represented by attorney Mat M. Gray III of Fowler, Rodriguez, Flint, Gray, McCoy and Sullivan in New Orleans.
