GRETNA – A corporate retailer is being sued by a woman who claims one of its employees injured her by dropping a number of boxes.
Madeline S. Slayton filed suit against Wal-Mart Stores Inc. in the 24th Judicial District Court on April 27.
Slayton claims she was shopping at the Wal-Mart located on West Loyola Drive in Kenner when an employee was pushing a cart loaded with heavy boxes and crates near her. The plaintiff alleges that as the cart was passing by, the boxes and crates toppled off of it and landed on her. Slayton contends she received severe and disabling injuries to her head, neck, back, spine and shoulders in the incident.
The defendant is accused of failing to maintain a proper lookout, overloading the cart, failing to maintain control of the cart and pushing the cart at an immoderate rate of speed.
An unspecified amount in damages is sought for medical expenses, paid and suffering, mental anguish, mental distress and impairment of earning capacity.
Slayton is represented by attorney Charles W. Dittmer Jr. of Metairie.
The case has been assigned to Division F Judge Michael P. Mentz.
