Auto repair shop sued by man who claims wheel fell off truck after being serviced

GRETNA – An auto repair shop and a technician are being sued by a motorist who claims they caused him to have an accident by not properly replacing the wheel on his truck.

Gustavo Sanchez-Pavon filed suit against The Goodyear Tire & Rubber Company, Goodyear Auto Service Center and Wayne Jackson in the 24th Judicial District Court on May 26.

Sanchez-Pavon alleges he brought in his 1997 Dodge Ram truck to the Goodyear Auto Service Center located in Kenner to have his tires inspected, rotated and his wheels balanced, which was completed by Jackson. The plaintiff contends that three days later he was driving his truck on Interstate 10 when his passenger’s side front tire fell off causing him to crash his truck. Sanchez-Pavon asserts the tire had been negligently reattached by the defendants resulting in the accident. The plaintiff claims he received severe and disabling injuries in the incident.

The defendant is accused of failing to properly inspect a tire, failing to properly complete the work, failing to secure the vehicle and violating the rules of the road.

An unspecified amount in damages is sought for medical costs, lost wages, loss of earning capacity, pain and suffering, disabilities, mental anguish, emotional upset, loss of enjoyment of life, rehabilitation costs, property damage and loss of use.

Sanchez-Pavon is represented by Brian G. Birdsall of New Orleans-based The Birdsall Law Firm.

The case has been assigned to Division J Judge Stephen C. Grefer.
