Hotel sued by guest claiming they gave unknown man a key to her room who assaulted her

Violence

NEW ORLEANS – A woman claiming a hotel employee gave a stranger a key to her room is suing.

Krishaune Hines filed suit against Cubs Motel Corporation, Econolodge, Patricia Santillana and Choice Hotels International Inc. on April 23 in the Orleans Parish District Court.

The plaintiff claims that on Oct. 14, 2014, an Econolodge employee checked the plaintiff into her room and that the room was reserved solely in the plaintiff’s name. However, the plaintiff contends a man, who identified himself as Calvin Smith, approached desk attendant Santillana and asked for a room key to the plaintiff’s hotel room. Without checking the room register records to see if Smith was an approved guest, the plaintiff claims Santillana made Smith a new card that would allow him access to the room, the suit says.

Hines asserts was alone in her hotel room when without warning Smith opened the door and began to brutally beat and batter her. The plaintiff contends Smith repeatedly punched and kicked her on her face and rammed her head and face into a door. Hines claims he severely injured her bones and muscles of her body, nerves, ligaments, tissues, and blood vessels as well as injuries to her back, neck, head and eye.

The defendant is accused of failing to train its employees, failing to supervise its employees, placing an individual in a perilous situation due to lack of supervision of its employees, failing to use reasonable vigilance, failing to implement proper security standards, failing to abide by the laws and regulations of the Parish of Orleans, and any other acts of negligence.

An unspecified amount in damages is sought for physical pain and suffering, mental pain and suffering, medical bills, loss of enjoyment of life, disability and loss of function, scaring and disfigurement, and any and all other damages which will be proven at the trial of this matter.

The plaintiff is represented by Casey W. Moll.

The case has been assigned to Division G Judge Robin M. Giarrusso.

Case no. 2015-3891.
