Hourly workers sue furniture business claiming overtime pay evasion

Two workers, individually and on behalf of a putative class, are suing their New Orleans employer and two of its managers alleging non-compliance with employment law in 2015 when the firm allegedly failed to pay overtime wages for hours worked in excess of 40 hours per week.

Wilmer Alex Palma and Jacob Lovo brought a class action complaint against Tormus Inc., doing business as Orleans Furniture & More, Jihad Isaid and Iseed Iseed in the U.S. District Court of the Eastern District of Louisiana on July 28, alleging willful Fair Labor Standards Act violation in an alleged evasion of overtime pay between April and July 2015.

According to the complaint, Palma worked for the defendant from April through July of 2015; and Lovo worked for the defendant performing manual labor from mid-May through late June 2015.

The suit states that the plaintiffs were paid in cash; that the defendant intentionally violated their rights by not compensating them at 1.5 times their $10 hourly wage when they worked in excess of 40 hours weekly; and that the practice has lasted at least three years.

The plaintiffs request declaratory and injunctive relief, general and equitable relief, pre- and post-judgment interest, attorneys' fees, expenses, and court costs. They are represented by Roberto Costales and William Beaumont in New Orleans.
