Company sues for contractor fees for Plaquemines Parish facility, alleges breach of contract

A Texas-based electrical maintenance company is suing a New York contractor over alleged unpaid fees in connection with the construction of a new air traffic control facility in Plaquemines Parish.

Fisk Electric Co. filed a lawsuit against J. Kokolakis Contracting Inc. and Liberty Mutual Insurance Co. in the U.S. District Court for the Eastern District of Louisiana on July 14, citing breach of contract in the construction of a naval air traffic control facility in Belle Chasse.

According to the complaint, Kokolakis entered into an agreement with Fisk on Aug. 8, 2011, as a subcontractor, in which Fisk would furnish labor, materials, equipment and supervision in doing certain demolition work, underground work and electrical work for the sum of $1,413,000.

Disruption to the project schedule and delays caused Fisk to extend its site presence, where it incurred significant additional costs to complete its work under the subcontract, the lawsuit claims. Fisk completed its work but was not paid in accordance with the subcontractor’s payment provision. Fisk performed work on the project until at least July 24, 2014.

The company is seeking $810,910.57 in unpaid dues.  Fisk is represented by New Orleans-based attorneys Lloyd N. Shields, Jessica R. Derenbecker and Adrienne C. May of Shields, Mott LLP in New Orleans.
