Man sues Bubba's restaurant for allegedly violating federal disabilities act

A wheelchair-bound man living on the campus at Nicholls State University is suing a nearby eatery for allegedly not having an accessible route to its entrance.

Andrew Schlesinger filed a lawsuit against Bubba’s II of Thibodaux Inc. on June 12 in the U.S. District Court of the Eastern District of Louisiana, citing a violation of the Americans with Disabilities Act.

According to the complaint, Schlesinger said he lives approximately 1.5 miles from Bubba's II Po-Boy restaurant and intends to frequent the restaurant. However, he fears that he will encounter some barriers to access the structure because he claims there is no accessible-designated parking at the property, no accessible route to the entrance to the eatery and the required clear floor space at the doorway into the restaurant is not level. The restaurant is at 212 E. Bayou Road, Thibodaux.

He is seeking the court to declare the property a violation of the Americans with Disabilities Act and order the property owners to alter the restaurant to make it accessible and usable for people with mobility disabilities to the full extent of the law.

Schlesinger is being represented by Garret S. DeReus and Andrew D. Bizer of the Bizer Law Firm in New Orleans.
