Damaged coal shipment prompts $800K lawsuit against cargo boat owners

NEW ORLEANS – A company and its insurer are suing a vessel, the African Falcon, and its owners, alleging they damaged cargo en route to South Africa.

Globe Metallurgical Inc. and AGCS Marine Insurance Co. filed a lawsuit Dec. 28 in U.S. District Court for the Eastern District of Louisiana against the marine vessel African Falcon, her engines, tackle, boilers, etc.; African Falcon Shipping Co. LTD; and MUR Shipping BV, alleging breach of duty.

According to the complaint, Globe Metallurgical chartered the African Falcon on Nov. 30, 2014, to transport a shipment of coal from Darrow, Lousiana to Richards, South Africa. Upon reaching its destination, the suit says the cargo was found short delivered or physically damaged, leaving the plaintiffs responsible for a loss of $821,000.

The plaintiffs have placed a lien on the vessel and seek damages of $821,000, plus litigation costs. They are represented by attorney Christopher E. Carey and Erzsebet M. Pifko of the New Orleans firm Pugh, Accardo, Haas, Radecker & Carely LLC.
