Concrete Steel and Erectors, Capitol Truck Services accused of breach of contract

NEW ORLEANS – Two Plaquemine businesses have filed a lawsuit against a construction company and a transporting company, alleging the companies neglected to pay their balance.

Verret Shipyard Inc. and Boaz Towing Inc. filed a suit in the U.S. District Court for the Eastern District of Louisiana on Jan. 28 against Concrete Steel and Erectors LLC of Prairieville and Capitol Truck Services Inc. of Baton Rouge, citing breach of contract.

According to the complaint, the defendants entered into a barge bareboat charter agreement with the plaintiffs on July 24. The agreement stipulates that a $17,000 monthly payment is to be made for the use of a B-3 Deckbarge, as well as interest, cost and expenses incurred for the use and operation of the barge, the suit states. Additionally, the barge is to be returned in its pre-charter condition, and to pay the charter hire, according to the complaint.

According to the suit, the agreement also states that in the event of default, all attorneys' fees incurred in enforcing the matter, as well as all subsequent fees regarding the charter agreement, shall become immediately due. The plaintiffs allege that the defendants have a balance due of $88,886.10.

The plaintiffs are seeking the balance due plus legal interest, reasonable attorneys' fees and expenses, the cost of the proceedings and for all general and equitable relief to which they are entitled.

The plaintiffs are represented by Jill S. Willhoft, Rufus C. Harris III, Alfred J. Rufty III and Cindy G. Martin of Harris and Rufty LLC in New Orleans.
