Homeowners say Lumber Liquidators knew flooring was laced with formaldehyde

NEW ORLEANS – A couple who installed Chinese-manufactured laminate flooring sold by Lumber Liquidators claims the company knew it failed to meet U.S. safety standards.

Erik and Kari McDonald filed a lawsuit on March 1 in U.S. District Court for the Eastern District of Louisiana against Lumber Liquidators Inc., Lumber Liquidators Leasing LLC, Lumber Liquidators Holdings Inc. and Lumber Liquidators Services LLC, alleging breach of warranty, product liability, unjust enrichment and negligence.

According to the complaint, the McDonalds purchased flooring from Lumber Liquidators that was made in China, which was found to have high levels of carcinogenic formaldehyde. The suit, however, says product labeling asserted that the flooring met U.S. safety standards. The plaintiffs state that they would not have purchased the flooring had they known of its dangerous content.

The McDonalds seek a jury trial, compensatory damages, interest and litigation costs. They are represented by attorneys Russ M. Herman, Leonard A. Davis and Stephen J. Herman of Herman, Herman & Katz LLC in New Orleans.
