Insurance company alleges Garda CL failed to deliver $170,000 to ATMs

BATON ROUGE – An insurance company is suing Garda CL Southeast Inc. for allegedly failing to deliver $170,000 to designated ATMs.

Travelers Casualty and Surety Co. of America filed a lawsuit on March 9 in the U.S. District Court for the Middle District of Louisiana against Garda CL Southeast Inc., citing breach of contract and negligent performance of duties under the armored car services agreement and ATM services agreement.

According to the complaint, Travelers is an insurance company that issued a bond in favor of Plaquemine Bancshares Corp., including coverage for loss of property while being transported in an armored motor vehicle. Plaquemine allegedly entered into an armored car service agreement and ATM services agreement with Garda CL Southeast Inc. on March 1, 2013.

The suit states that on March 9, 2015, Plaquemine Bank placed an order of $170,000 in U.S. currency from the Federal Reserve Bank of New Orleans for its ATMs, which was debited the following day. The plaintiff claims that the defendant never delivered the money to Plaquemine Bank and that on May 29, 2015, the bank provided a sworn proof of loss seeking coverage under the bond for its loss. The plaintiff avers that the defendant’s negligence and breach of contracts entitles them to payments for the undelivered currency.

Travelers Casualty and Surety Co. of America seek damages in the amount of $170,000, plus interest from the date of judicial demand until paid, attorney’s fees and costs. It is represented by Matt J. Farley and Richard Baudouin of Krebs Farley PLLC in New Orleans.
