Financing company alleges equipment renter damaged property

SHREVEPORT — A financing and leasing company is suing an equipment rental company, alleging willful and malicious injury.

Western Equipment Finance, Inc. filed a complaint Feb. 12, in U.S. District Court for the Western District of Louisiana against McGee Equipment Rental & Sales, Inc. alleging the rental company committed willful and malicious injury to its property.

According to the complaint, Western Equipment suffered damages of $78,952.29. The plaintiff alleges the defendant willfully and maliciously converted their collateral by transferring possession of the 10 remaining welders to third parties without prior authority or permission and refusing to surrender the 10 remaining welders after their demand.

Western Equipment Finance seeks a trial by jury, the $78,952.29, costs and disbursements incurred, and any further relief the court may deem just. It is represented by attorneys Craig M. Cousins and Patrick M. Wartelle of Leake & Andersson LLP in New Orleans.
