Industrial business alleges rig manufacturer owes $1.1 million

LAFAYETTE — An Illinois industrial services provider is suing a Louisiana rig manufacturer, alleging it owes more than $1.1 million for services provided.

Industrial Coating & Fireproofing LLC of Mokena, Illinois, filed a lawsuit April 6 in U.S. District Court for the Western District of Louisiana Lafayette Division against Superior Derrick Services LLC of St. Martinville, alleging failure to comply with an agreement to pay for materials and services provided.

According to the complaint, from 2013 to 2015, Superior Derrick requested Industrial Coating to provide sandblasting and painting services and materials to the defendant's job sites in St. Martin Parish. Upon completion of each service, the plaintiff would issue an invoice, the suit says. 

Industrial Coating received some payments but not all, the lawsuit states, and Superior Derrick is currently indebted in the amount of $1,101,693.22. 

The plaintiff alleges the defendant has refused to pay the agreed price despite completion of its obligations and Superior Derrick's failure to object to any of the invoices.

Industrial Coating and Fireproofing seeks a trial by jury, a judgment of $1,101,693.22, plus reasonable attorney fees and all other equitable relief to which it is entitled. It is represented by attorneys John C. Person and Justin H. Homes of Sessions, Fishman, Nathan & Israel LLC in Metairie.
