Two construction workers allege they were not paid overtime wages

NEW ORLEANS – Two construction workers have filed a class-action lawsuit against general contractors and construction companies over allegations that they were not paid overtime wages.

Wilson Nunez and Luis Mejia filed a complaint on behalf of other persons similarly situated on April 13 in the U.S. District Court for the Eastern District of Louisiana against Orleans Shoring LLC, Santicima Trinidad LLC, La Divina Misericordia LLC, Antonio Nunez and Antonio Nunez Reyes, alleging that they violated the Fair Labor Standards Act.

According to the complaint, the plaintiffs allege that between August 2015 and February 2016, they were not paid one-and-a-half times their hourly rate for all hours worked in excess of 40 in a work week. The plaintiffs holds the defendants responsible because the defendants allegedly failed to properly compensate them for all their extra hours performed and showed reckless disregard for the fact that their compensation practices violated the law.

The plaintiffs request a trial by jury and seek an order enjoining defendants from violating the FLSA’s overtime and minimum wage provisions, compensation for unpaid wages plus interest, liquidated damages, attorneys’ fees and costs, prejudgment and post-judgment interest and such other relief as the court may deem equitable and just.
