Carbon business accuses Massachusetts corporation of negligent representation

NEW ORLEANS — An Orleans Parish carbon manufacturer is suing a Massachusetts corporation, alleging failure to comply with a warranty agreement. 

Atlas Carbon LLC filed a lawsuit April 13 in U.S. District Court for the Eastern District of Louisiana against Munters Corporation alleging, breach of contract, breach of warranty and negligent misrepresentation.

According to the complaint, in December 2014, Atlas Carbon entered into a contract with Munters to manufacture a heat exchanger system, In January 2016, the suit says, the plaintiff experienced problems with the system and, upon discovery, the heat exchanger system was warped or distorted. 

The lawsuit states the damage renders the system inoperable for all intents and purposes, bringing downtime and substantial disruption for Atlas Carbon's operations. The plaintiff alleges Munters negligently designed and manufactured the heat exchanger, failed to meet the required specifications, failed to fix it and failed to reimburse the purchase price.

On Feb. 26, the suit says, a Munters regional sales manager agreed that the exchanger appeared to be damaged and deformed.

Atlas Carbon seeks a trial by jury, compensation for the full amount of purchase price plus interest, all damages sustained, statutory damages, attorney fees and legal costs, and any other equitable relief the court deems proper.
