Couple accuses Livingston Parish law enforcement of false arrest

BATON ROUGE — A Livingston Parish couple is suing parish law enforcement officials, alleging false arrest. 

Columbia Casualty Company, Deputy William Durkin and Sherif Jason Ard, individually and in his official capacity as Livingston Parish Sheriff, government employees, citing alleged false arrest.

William J. Aubin, Jr. and April Aubin filed a lawsuit April 28 in U.S. District Court for the Middle District of Louisiana against Columbia Casualty Company, deputy sheriff William Durkin and Livingston Parish Sheriff Jason Ard, alleging they violated the U.S. Constitution and other laws of the United States and of the state of Louisiana in making a false arrest.

According to the complaint, on April 30, 2015, the plaintiffs were at their home near Denham Springs when Durkin drove down the street in a marked patrol car in response to a complaint concerning their neighbor. The suit says Durkin arrested William Aubin for allegedly interfering with a law enforcement investigation, public intimidation, retaliation and resisting an officer. 

The complaint states Durkin’s charges against William Aubin ultimately were dismissed by the district attorney. As a consequence of the damages suffered by Aubin, the lawsuit says, his wife April suffered the loss of consortium, society and services. 

The Aubins allege the defendants committed battery, assault, false arrest, false imprisonment, unlawful seizure, cruel treatment, excessive use of force and malicious prosecution.

The Aubins seek a trial by jury, compensation for special damages, punitive damages, attorney fees, costs, interest, and other recoverable damages and appropriate relief. They are represented by attorney Kearney S. Loughlin of New Orleans.
