Consumer blames pharmaceuticals companies for Xarelto side effects

NEW ORLEANS — A Michigan man is suing a group of pharmaceutical companies, alleging a drug they produced and marketed caused him health problems. 

Richard Polakowski filed a lawsuit April 13 in U.S. District Court for the Eastern District of Louisiana against Janssen Research & Development LLC, Janssen Ortho LLC, Janssen Pharmaceuticals, Inc., Bayer Healthcare Pharmaceuticals, Inc., Bayer Pharma AG, Bayer Corporation, Bayer Healthcare LLC, Bayer Healthcare AG and Bayer AG, alleging breach of warranty, negligent misrepresentation and violation of the Consumer Protection Law.

According to the complaint, Polakowski began using Xarelto in April 2013 up until approximately Aug. 14, 2013. As a result of using Xarelto, the suit says, he suffered serious and dangerous side effects including interalia life-threatening bleeding, as well as other severe and personal injuries that are permanent and lasting in nature, physical pain, mental anguish. The lawsuit states he sustained expenses for hospitalization and medical care. 

The plaintiff alleges the defendants designed, researched, manufactured, tested, advertised, promoted, marketed, distributed and sold Xarelto, failed to properly investigate, research, study and define the safety profile of Xarelto, failed to adequately test it or provide adequate warnings, failed to disclose the need for dose adjustments and failed to provide adequate instructions.

Polakowski seeks a trial by jury, compensation for all damages, pre-judgment and post judgment interest, attorney fees, legal costs and such other relief the court deems proper. He is represented by attorneys Roger C. Denton, Kristine K. Kraft and Ashley Brittain Landers of Schlichter, Bogard and Denton in St. Louis.
