Family accuses VA hospital of negligence in diagnosing cancer

ALEXANDRIA – The family of a deceased veteran allege that his cancer wasn't diagnosed soon enough because of the negligence of a hospital. 

Norma Osteen, Kevin Osteen, Cotranda Osteen and Devin Osteen, individually and on behalf of Johnny R. Osteen, deceased, filed a complaint on May 11 in the U.S. District Court for the Western District of Louisiana, Alexandria Division against United States of America alleging negligence.

According to the complaint, the plaintiffs allege that decedent Johnny R. Osteen was a patient at Alexandria VA Health System in Pineville. After being a patient at said hospital for many years, his lung cancer was advanced when it was diagnosed for the first time on April 4, 2014, the suit states. He passed away on April 19, 2014, from lung cancer, according to the claim.

As a result, plaintiffs allege they have suffered loss of love and affection, loss of emotional support and companionship. The plaintiffs hold United States of America responsible because the defendant allegedly failed to perform repeat chest X-rays, failed to recommend additional diagnostic studies, failed to properly and timely implement hospital procedures, failed to provide appropriate follow-up care and treatment and failed to protect decedent from a reasonably foreseeable risk of injury or death.

The plaintiffs request a trial by jury and seek judgment against defendants in the sum of $800,000, plus costs of this suit and such other and further relief as the court may deem proper. They are represented by Benjamin P. Mouton of McGlynn, Glisson & Mouton in Baton Rouge.
