Contractor alleges oil exploration company owes $133,000

NEW ORLEANS — A Louisiana contractor is suing a Texas oil exploration company and owner, alleging failure to pay more than $133,000.

Blackwater Diving LLC filed a complaint May 9 in U.S. District Court for the Eastern District of Louisiana against Benjamin Smith and Monforte Exploration LLC, alleging breach of contract in failing to pay the amounts owed.

According to the complaint, on June 18, 2015, a judgment was entered in Blackwater's favor and against defendant in the amount of $144,560.83, and in July 2015, in the event of a default of the payments, Smith personally guaranteed the payment. 

The plaintiff alleges Monforte made payments totaling $55,000 but defaulted on its remaining payments and Smith, despite his agreement, refused to pay the amounts defaulted on by Monforte for $133,925.

Blackwater Diving seeks a trial by jury, judgment of $133,925, plus interest, attorney fees, legal costs and all other relief to which it may be entitled. It is represented by attorneys R. Joshua Koch Jr. and Caitlin Morgenstern of Koch & Schmidt LLC in New Orleans.
