Laborer accuses employers of not paying overtime

NEW ORLEANS — A Louisiana laborer is suing multiple employers, alleging failure to pay overtime wages.

Cristian Rodriguez filed a class action lawsuit, individually and on behalf of other persons similarly situated, May 17 in U.S. District Court for the Eastern District of Louisiana against Alsalam, Inc., Ariyan, Inc., Discount Max 2 Inc. and Ahmad Dorry, alleging they violated the Fair Labor Standards Act in failing to pay overtime.

According to the complaint, Rodriguez, who worked as a custodian, did not receive overtime premium or any compensation for all extra hours he worked in excess of 40 hours per week. The plaintiff alleges the defendants failed to compensate him at the rate of one-and-a-half times his regular hourly rate for all hours worked of more than 40 hours a week and treated him as exempt from the FLSA’s minimum wage and overtime requirements.

Rodriguez seeks a trial by jury, compensation for unpaid minimum wages, unpaid overtime wages, interest, liquidated damages, attorney fees, legal costs and such relief as the court deems equitable. He is represented by attorneys Roberto Luis Costales and Emily A. Westermeier of Costales Law Office in New Orleans, and by William H. Beaumont of New Orleans.
