Parents allege that minor child was molested on bus by fellow student

GRETNA – A family is seeking damages following an incident in which their minor child was allegedly sexually or physically molested by another student.

The parents of the minor child filed a suit against the parents and tutors of a minor student, First Student Inc., ABC Insurance Co., Jefferson Parish School Board and XYZ Insurance Co. in the 24th Judicial District Court on May 13.

According to the claim, the students attended Estelle Elementary School and were on a school bus that was operated by First Student Inc., on May 13, 2015, when the incident occurred. The suit states that while on the bus, the defendants' minor child sexually or physically molested and/or performed lewd acts in the presence of the plaintiffs' minor child, causing the plaintiff child psychological harm, emotional trauma and distress, as well as other damages.

The defendant parents are accused of fault, intent, negligence and gross negligence through their failure to inform the child of laws against such conduct, failure to supervise the child and overall negligence. The Jefferson Parish School Board is accused of failing to monitor the students and properly train and supervise its employees. First Student Inc. is accused of failing to properly monitor the students while on the bus.

The plaintiffs are seeking an unspecified amount in damages. They are represented by Cheryl Ann McAnespy-Smith in Harvey. The case has been assigned to Division O Judge Danyelle M. Taylor.
