Collection agent alleges ears were injured by caller using horn

NEW ORLEANS – A collection agent alleges her hearing was damaged when a caller used an air horn.

Jean D. Martson filed a complaint on May 25 in the U.S. District Court for the Eastern District of Louisiana against Aero-Septic Maintenance Inc., Lee Ann Pierce and Liberty Mutual Insurance Co. alleging that defendant Pierce intentionally inflicted injury.

According to the complaint, the plaintiff alleges that, on July 24, 2015, she was wearing a headset when she answered a phone call from defendant Pierce, an employee of defendant AeroSeptic. Upon answering the phone, the plaintiff alleges she was exposed to a blast from an air horn, causing her to sustain serious and permanent injuries her ears, necessitating the use of hearing aids and resulting in a permanent tinnitus condition in both ears. The plaintiff holds Aero-Septic Maintenance Inc., Pierce and Liberty Mutual Insurance Co. responsible because the defendant Pierce allegedly discharged the air horn twice from the other end of the phone line.

The plaintiff requests a trial by jury and seeks compensation for all damages, plus penalties, reasonable attorney fees and costs and for all general and equitable relief to which she is entitled. She is represented by Charles P. Ciaccio of Frank J. D'Amico Jr. APLC in New Orleans.
