Disabled man alleges New Orleans property owners violated ADA compliance laws

NEW ORLEANS — A disabled Orleans Parish man is suing New Orleans property owners, alleging failure to provide access to their facilities for handicapped patrons.

Thad Tatum filed a lawsuit June 23 in U.S. District Court for the Eastern District of Louisiana against Kitchen Depot LLC, Wei L. Xie and Guang Q. Chen, alleging disability discrimination and failure to uphold Americans with Disabilities Act regulations.

According to the complaint, during Tatum's last visit to the defendants' property, 8739 Airline Highway, New Orleans, on June 9, he experienced serious difficulties accessing the goods and utilizing the services offered due to architectural barriers preventing access for handicapped patrons. The plaintiff alleges the defendants failed to provide accessible-designated parking spaces, failed to provide curb ramp or a curb cut onto the promenade from the parking lot and failed to adopt any alternatives to barrier removal.

Tatum seeks a trial by jury, declaration the defendants' properties violate the ADA, an order directing the defendants to make the property accessible to and usable by individuals with mobility disabilities, attorney fees, legal costs and expenses, plus other relief as the court deems necessary, just and proper.
