Disabled man alleges facility operator failed to comply with ADA

NEW ORLEANS — A Jefferson Parish man is suing a Metairie facility operator, alleging failure to provide access for the disabled. 

Stephen Carrier of Metairie filed a lawsuit June 24 in U.S. District Court for the Eastern District of Louisiana against KCL Properties LLC, alleging failure to uphold Americans with Disabilities Act regulations.

According to the complaint, on June 3, Carrier, who is disabled, patronized Smoothie Time, at 3908 Veterans Memorial Blvd. Metairie, and experienced serious difficulties accessing the goods and utilizing the services offered due to various architectural barriers. The plaintiff alleges KCL Properties failed to remove the barriers to allow Carrier to access at property, even though their removal is readily achievable.

Carrier seeks a trial by jury, declaration the defendant's property violates the ADA, an order directing the defendant to alter its property to make it accessible to and usable by individuals with mobility disabilities, reasonable attorney fees, legal costs and expenses, plus such other relief the court deems necessary, just and proper.
