Consumer alleges retail company failed to make proper disclosure

LAFAYETTE — A Louisiana man has filed a class action lawsuit against a retail company, alleging failure to provide copies of consumer reports, notices and disclosure when the plaintiff applied for a job.

Derrick Dennis of Lafayette Parish filed a class action lawsuit, individually and on behalf of all others similarly situated, June 27 in U.S. District Court for the Western District of Louisiana Lafayette Division against Stine LLC alleging that the retail company violated the Fair Credit Reporting Act.

According to the complaint, Dennis suffered actual financial damages in that he was denied employment with Stine based on information it obtained in a consumer report/background check. Although he was arrested for a crime, the suit says, the crime has not and will not be prosecuted. 

The plaintiff alleges Stine deprived Dennis the opportunity to explain, and unlawfully obtained the plaintiff's consumer report for employment purposes without first providing a clear and conspicuous written disclosure that a consumer report could be obtained for employment purposes.

Dennis seeks a trial by jury, seeks declaratory judgment the defendant's practices are unlawful, actual and punitive damages, attorney fees and legal costs, plus any other relief the court deems just and proper. He is represented by attorney Justin R. Mueller of Mueller Law Firm in Lafayette.
