NEW ORLEANS — A consumer has filed suit against an RV dealer for alleged breach of implied warranty.
Todd Bergeron filed a complaint June 27 in U.S. District Court for the Eastern District of Louisiana against Forest River Inc., Bent's RV Rendezvous LLC and Bank of the West, alleging that they violated the Magnuson Moss Warranty Act.
According to the complaint, the plaintiff alleges that on May 16, 2014, he purchased a new Coachman Chapparal for personal use. When delivered, the vehicle was defective in materials and workmanship. The plaintiff holds Forest River Inc., Bent's RV Renezvous LLC and Bank of the West responsible because the defendants allegedly failed to repair the vehicle in a timely and workmanlike manner.
The plaintiff requests a trial by jury and seeks judgment against the defendants for cancellation of the debt, rescinding the sale of the vehicle and returning the purchase price, out-of-pocket expenses, prejudgment and post-judgment interest, attorney fees, costs and all other relief the court deems appropriate.
