Human resources worker alleges IHOP failed to pay proper overtime

NEW ORLEANS — A Louisiana woman is suing IHOP, alleging failure to pay federally mandated overtime wages.

Kimberly VanCott filed a lawsuit June 30 in U.S. District Court for the Middle District of Louisiana against Ruby Enterprises LLC, doing business as a IHOP, alleging violation of the Fair Labor Standards Act.

According to the complaint, throughout the course of VanCott's employment in IHOP's corporate offices, she frequently worked more than 40 hours a week without receiving proper compensation. 

The plaintiff alleges IHOP showed reckless disregard for its compensation practices by not paying overtime premium for those hours worked more than 40 per week and refused to provide payment of vested vacation time and failed to provide VanCott with a health care continuation notice.

VanCott seeks a trial by jury, declaration the defendant's acts and practices violated FLSA, restraining the defendant from engaging in such unlawful practices, compensation for all damages, pre-judgment interest, attorney fees and such relief as the court deems just and proper.
