NEW ORLEANS — A seaman is suing a maritime company, alleging negligence led to the plaintiff sustaining injuries.
David J. Benner filed a lawsuit July 6 in U.S. District Court for the Eastern District of Louisiana against Adriatic Marine LLC, alleging negligence in that the defendant breached its legally imposed duty to protect the plaintiff.
According to the complaint, on June 6, 2016, Benner was in an accident aboard the MV Adriatic, resulting in injuries to his neck, back, head, knee and other parts of his body. The suit says he sustained physical, mental and emotional pain and suffering, loss of wages, disability and medical expenses.
The plaintiff alleges Adriatic Marine failed to provide a reasonably safe place to work, failed to properly train and supervise Benner, failed provide minimum safety requirements and created and maintained an un-seaworthy vessel.
Benner seeks a trial by jury, adequate maintenance benefits, payment of all cure benefits to which he is entitled and any additional applicable damages. He is represented by attorneys Timothy J. Young, Tammy D. Harris, Megan C. Misko and Daniel J. Poolson of The Young Law Firm in New Orleans.
