Ship worker alleges vessel owner allowed unsafe work environment

Tugboat 01

NEW ORLEANS — A Terrebonne Parish man is suing a vessel owner, alleging its negligence led to the plaintiff sustaining injuries.

Willis Trosclair filed a lawsuit July 13 in U.S. District Court for the Eastern District of Louisiana against Enterprise Marine Services LLC, alleging failure to warn and failure to provide a safe place to work.

According to the complaint, on Aug. 15, 2014, Trosclair was working aboard the M/V Paddy and as he stepped outside the cabin over a raised threshold, a rug slipped under his feet. The suit says Trosclair fell and hit the bulwark, resulting in injuries to both shoulders, left elbow and neck.

The plaintiff alleges Enterprise Marine failed to provide a seaworthy vessel, and allowed a dangerous slip/fall hazard condition on the ship.

Trosclair seeks a trial by jury, judgment of $3 million with legal interest, and $1 million for punitive, exemplary and compensatory damages as well as attorney fees, plus general, legal, and maritime relief. He is represented by attorneys C. Arlen Braud II, Michelle O. Gallagher and Steven D. Jackson of Braud & Gallagher LLC in Mandeville.
