Restaurants allege leasors' actions caused them monetary losses

Contract 03

NEW ORLEANS – Two restaurants are seeking damages for alleged breach of contract.

A Bar and Grill with a Bite and La Criollo Inc. filed a suit against The Howard Hughes Corp., Frank P. Quinn and Riverwalk Marketplace (New Orleans) LLC, formerly known as New Orleans Riverwalk Associates, in the Orleans Parish Civil District Court on July 27.

According to the claim, the plaintiffs, doing business as Poppy's Crazy Lobster and Poppy's Time Out, leased space from the defendants on Spanish Plaza. The suit states that over the years the defendants have repeatedly failed to negotiate in good faith and have intentionally committed misconduct towards the plaintiffs regarding the leases, which they allege have caused them to suffer monetary losses and emotional damage.

The defendants are accused of breach of contract, intentional misrepresentation and bad faith.

The plaintiffs are seeking an unspecified amount in damages. They are represented by Russ M. Herman and John S. Creevy of Herman, Herman & Katz LLC in New Orleans.

The case has been assigned to Division C Judge Sidney H. Cates IV, Chief Judge.
