Brothers engaged in alleged dispute over inherited property

NEW ORLEANS – A brother is seeking judicial intervention in a dispute, claiming that his transient brother refuses to sell the vacant lot they co-own.

Alexander R. Barthe filed suit against Edwin J. Barthe Jr. in the Orleans Parish Civil District Court on Aug. 16.

According to the claim, the plaintiff and the defendant are the property owners of the lot at 3412 Pauger St. The suit states that the plaintiff is the owner of 75 percent of the property interest and the defendant is the owner of 25 percent of the interest. The suit states that plaintiff has attempted to sell the property but that the defendant refuses to comply, despite owning only 25 percent of the property.

The defendant is accused of refusal to comply or negotiate the sale of the property.

The plaintiff seeks a judicial ruling to force his brother to sell his share of the property and the proceeds be divided among the two brothers and their two sisters. He is represented by Halima Narcisse Smith.

The case has been assigned to Division B Judge Regina Bartholomew Woods.

The Orleans Parish Civil District Court case number 16-8202.
