Homeowner alleges work performed by Tim Clark Construction damaged home

Contract 01

NEW ORLEANS – A New Orleans woman claims that the contractor who worked on her home damaged it.

Kimberly Michelle Matthews filed a suit against Tim Clark Construction LLC, Gemini Insurance Co. and XYZ insurance company in the Orleans Parish Civil District Court on May 26.

According to the claim, the plaintiff lives at the location of 4334 Randolph Ave. and paid the Tim Clark Construction LLC to complete work on her residency. The suit states, however, that the defendant failed to perform the work to the standards that he claimed in the contract, even damaging the property during his performance of work. The plaintiff alleges she contacted the company numerous times to repair the work but did not receive a response.

The defendant is accused of breach of contract and breach of duty through failing to deliver the level of work agreed upon.

The plaintiff is seeking an unspecified amount in damages. She is represented by Harold J. Flanagan of Flanagan Partners LLP in New Orleans.

The case has been assigned to Division J Judge Paula A. Brown.
