Disabled Wisconsin tourist blames travel businesses for injuries

BATON ROUGE — A disabled Wisconsin woman is suing two tourist businesses and an insurance company, alleging negligence led to her sustaining injuries.

Rosemary Varney filed a lawsuit Aug. 12 in U.S. District Court for the Middle District of Louisiana against Hotard Coaches Inc., All Aboard America! Holding Inc. and Lancer Insurance Company, alleging they negligently entrusted a bus driver with her safety.

According to the complaint, on Sept. 3, 2015, Varney, who needs a wheelchair, was a part of a tour group touring the Mississippi River on board the vessel Queen Mississippi. The suit says the group disembarked in Baton Rouge to tour the area via defendants' tour bus. 

The lawsuit states the bus driver loaded Varney's wheelchair directly in front of her, and, while traveling, the wheelchair fell on the plaintiff's leg causing severe injuries. The suit says Varney sustained pain and suffering, disfigurement, mental anguish and medical expenses. 

The plaintiff alleges the defendants' driver failed to properly secure the wheelchair, negligently placed it in front of her and failed to exercise the highest degree of care.

Varney seeks trial by jury, judgment in an amount to be proven at the trial, plus court costs, legal interest and all just relief. She is represented by attorney Brian C. Colomb of Domengeaux Wright Roy Edwards & Colomb LLC in Lafayette.
