NEW ORLEANS – A Loranger man is accused of violating his contract with his former employer.
Brand Energy Solutions LLC filed a complaint in the U.S. District Court for the Eastern District of Louisiana against Andy Rakocy alleging that the former employee violated his employment agreement.
According to the complaint, Rakocy is a former sales manager of the plaintiff that resigned to work for a competitor. The plaintiff alleges Rakocy executed a promissory note in April for $3,648.54 that was due in July, but the defendant defaulted on this note. The plaintiff also alleges the defendant breached his contract regarding noncompetition and nonsolicitation.
The plaintiff holds Rakocy responsible because the defendant allegedly immediately began employment with a direct competitor, attempted to solicit at least three of plaintiff's customers on behalf of his new employer and failed to meet his repayment obligations.
The plaintiff requests a trial by jury and seeks judgment be made and entered in its favor for preliminary and permanent injunctions prohibiting defendant's continued violation of his employment agreement, compensation for damages, costs and attorneys’ fees and such other relief as the court deems just.
