NEW ORLEANS – A family claims that leaks from the rental unit above them caused water and sewage to pool in their home, causing a fall and sickness.

Angela Allen, Tyron Allen, Tyrell Allen, individually and on behalf of two children, filed a suit against Graham Packard LLC in the Orleans Parish Civil District Court on April 9.

According to the claim, the plaintiffs were renting a home that was owned by the defendant. The suit states that on April 7, 2015, the ceiling in the plaintiff's bathroom had been damaged by leaking water and sewage from the unit above them, and water leaked onto the floor. The suit states that Angela Allen was caused to slip and fall on the floor, resulting in injuries. The suit also states that the smell from the sewage caused the plaintiffs to become ill.

The defendant is accused of negligence through failing to maintain the home in a suitable condition, failing to make necessary repairs and allowing the property to deteriorate.

The plaintiffs are seeking an unspecified amount in damages. The plaintiffs are represented by Kevin M. Riley and Michael D. Riley of New Orleans.

The case has been assigned to Division B Judge Regina Bartholomew Woods.
